Construction projects, whether involving a new commerical structure or a remodeling of a residental bathroom, often commences with the contractor and owner reaching an understanding to amicably resolve between them any disputes that may arise during the project. In reality, this most often does not occur as each side takes adamant position as to what is appropriate and fair.
Construction disputes can have many variables such as, poor workmanship, cost overruns, work changes, weather damage or delay, and subcontractor delay. What connects these disputes is that they are factual in nature and usually are not conflicts over legal issues.
Mediation is the best alternative to resolving construction disputes. Submitting a dispute to mediation allows the parties to present their claim before an impartial neutral mediator, which requires each party to listen to the others position, and to conduct a serious analysis of the merits of their case.
